Trade secret disputes can be a game of hide and seek. In Belgium, intellectual property right holders can revert to the saisie contrefaçon, an effective ex parte measure to collect evidence of infringement. However, that procedure is not available to the holders of trade secrets. In the peer-reviewed Belgian law journal IRDI, Inteo lawyer Kristof Neefs explores alternatives to collect evidence of trade secret misappropriation on an ex parte basis.
